1. BINDING AGREEMENT

READ THIS ENTIRE TERMS OF USE AGREEMENT (“AGREEMENT”) CAREFULLY BEFORE USING THIS FOUNDATION’S WEBSITE, EMAILS, ONLINE PROPERTIES, OR PUBLICATIONS.

This Agreement is a binding legal contract between Doc1 Foundation (also referred to as “Foundation,” “we,” “us,” or “our”) and the end user (“User,” “you,” or “your”) that governs your use of one or more of the Foundation’s emails and online properties, including, without limitation, all content such as text, information, images, applications, and audio (collectively, “Content”) and all services (“Services”) made available to you through the Foundation by us and/or third parties (this website and the Content and Services are collectively referred to herein as the “Site”). Site refers to the pages within the Foundation’s websites and emails.

By using the Foundation’s Content and Services in any manner whatsoever, you indicate your conclusive acceptance of this Agreement. If you do not agree to this Agreement, do not access or use this Site in any manner whatsoever.

2. INFORMATION DISCLAIMER

THE INFORMATION PRESENTED BY THIS FOUNDATION IN EMAIL AND ONLINE WEB PAGES IS FOR ENTERTAINMENT, EDUCATIONAL, AND INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS QUALIFIED HEALTH, MEDICAL, OR FINANCIAL ADVICE. ANY ACTION YOU TAKE BASED ON THIS INFORMATION IS AT YOUR OWN RISK AND EXPENSE. READERS ARE ADVISED TO CONSULT QUALIFIED PROFESSIONALS ABOUT HEALTH, WELLNESS, AND FINANCIAL ISSUES. NOTHING ON OUR SITE CONSTITUTES LEGAL, TAX, INVESTMENT, FINANCIAL, OR OTHER ADVICE.

3. EMAIL FROM THE FOUNDATION

Users may subscribe or unsubscribe easily. If you have received an email newsletter or third-party email promotion from this Foundation and wish to be removed, please unsubscribe or opt-out by clicking on the link in the footer of every email. Alternatively, you may contact the Foundation using the address on our Contact Us page.

Requests to unsubscribe electronically are processed immediately. Other methods may take up to 10 business days. Opting into another property operated by the Foundation with a different email address may result in additional emails being sent.

4. YOUR USE OF CONTENT

All Content is copyrighted by the Foundation or by third parties who have granted the Foundation usage rights. You may download and print a single copy of the Content for non-commercial, personal use only. Altering Content or removing copyright notices is strictly prohibited.

Unauthorized use of Content is considered copyright infringement and may result in civil or criminal penalties under applicable law.

RSS feeds provided by the Foundation must link directly to the source material on the Foundation’s Site. Modifications, redirect links, or intermediary pages are not permitted.

5. INTELLECTUAL PROPERTY OWNERSHIP

The Foundation or its Content Providers retain ownership of all rights, titles, and interests in the Site and its Content. This Agreement does not grant any express or implied rights to use the intellectual property of the Foundation beyond those explicitly stated.  This includes, but is not limited to trademarks, service marks, texts, pictures, videos, software, information, other files, and anything else that is proprietary property to the Doc1 Foundation that is protected by U.S. copyright, trademark, and any other intellectual property laws.

6. INTERACTIVE AREAS

The Foundation provides Interactive Areas, including discussion forums, comment sections, and other electronic communication tools. Users are responsible for their posts and must comply with applicable laws. Prohibited content includes defamatory, obscene, or infringing materials, and the Foundation reserves the right to remove such content at its discretion.

By submitting materials to Interactive Areas, you grant the Foundation a royalty-free, perpetual, worldwide license to use and distribute such materials.

7.  DONATIONS

Any user visiting our site may become a donor by donating to the Doc1 Foundation through the donation options provided on this website.  Understand that your donation is being made directly to the Doc1 Foundation, and the Doc1 Foundation has legal exclusivity over the control of all donations.  If you make a donation that requires you to provide information at the time of your donation, you represent and agree that all payment information that you provide to either the Doc1 Foundation, affiliates or third-party services is current, true, accurate and complete to the best of your knowledge.  If a payment can’t be processed due to inaccurate information or insufficient funds, you agree to provide the Doc1 Foundation immediate alternative payment information to fulfill your donation.  You also agree that all donations are final and will not be returned, in part or in whole.

8. ADVERTISEMENTS AND LINKS

The Foundation may include third-party advertisements or links to external websites. These sites are not under our control, and the Foundation is not responsible for their content or services. Visiting these sites is at your own risk and subject to their terms.

9. GENERAL DISCLAIMERS

The Site and its Content are provided “AS IS.” The Foundation makes no warranties regarding the accuracy, completeness, or reliability of the Content. Accessing the Site is at your own risk, and the Foundation disclaims responsibility for any errors, interruptions, or harm resulting from its use.  The Doc1 Foundation controls and operates this Site from the United States.  We make no representations that the materials on or in this Site are appropriate or available for use in other locations, and access to this Site from territories where the contents of this Site might be deemed illegal or are prohibited.  It is your choice and decision to access this Site from another location and you do so at your own risk and an understanding of the laws in your area.

The Terms may at any time be updated, modified or amended by the Doc1 Foundation.  The Doc1 Foundation will not be help liable or bound by any other modifications or amendments to these Terms unless they are expressly accepted in writing by the Doc1 Foundation and must reference such Terms. 

Some jurisdictions may not allow certain warranty exclusions, so these limitations may not apply to you.

10. EXCLUSION OF DAMAGES

The Doc1 Foundation, its Officers, Directors, Employees, Volunteers, Agents, Affiliate are not liable for direct, indirect, incidental, punitive or consequential damages arising from the use of the Site. This limitation applies even if the Foundation has been advised of the possibility of such damages.

11. INDEMNITY

You agree to indemnify and hold the Foundation harmless from any losses, damages, or claims resulting from your breach of this Agreement or unauthorized use of the Site.

12. YOUR PRIVACY

Your use of the Site is subject to our Privacy Policy, which explains how your data is collected, used, and protected. Please review our Privacy Policies to ensure you understand and agree to its terms.

13. ENTIRE AGREEMENT

This Agreement, including the Privacy Policy, constitutes the entire agreement between you and the Foundation concerning the Site.

14. TERMINATION

The Doc1 Foundation reserves the right to terminate your access to the Site for violations of this Agreement.  Termination is at the sole discretion of the Doc1 Foundation and will be without notice.  You hereby release Doc1 Foundation from any and all claims, damages, liabilities and causes that may arise out of the modification or discontinuance of any and all features on the Site and the termination of your access to this Site or any of our associated services. The Doc1 Foundation reserves the right to discontinue the Site or any other associated service at any time without any notice.

15. ASSIGNMENT AND ENFORCEMENT

The Foundation may assign this Agreement at its discretion. Unauthorized assignment by you is void.

16. PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT

If you believe your copyrighted material has been infringed, please contact us with detailed information, including:

  • A description of the copyrighted work.
  • The location of the infringing material.
  • Your contact information.
  • A good-faith statement affirming your ownership of the material.

The Foundation will review claims and take appropriate action, such as removing the material or crediting its rightful owner.

17. RIGHT TO REVISE AGREEMENT

The Foundation reserves the right to revise this Agreement at any time. Continued use of the Site constitutes acceptance of such changes.
